Terms & Conditions

1. SOLE PROVIDER

For reputation management and food safety reasons, all cakes for your event must be supplied by Soolicious Cake. If any cakes or desserts are provided by an individual or company other than Soolicious Cake (including groom’s cakes), please notify the details to Soolicious Cake before the agreement. If Soolicious Cake is not notified of the details, we reserve the right to leave your venue without setting up your cake, and all payments made to us will be forfeited. We will dispose of your undelivered cake at our discretion.

 

2. DEPOSITS:

   a) We require a 50% non-refundable deposit for all orders exceeding $100. This payment serves to hold the date of event or wedding and is payable at the time of confirming orders.

   b) The final payment is due 14 days prior to delivery or pick-up date for custom cakes.

3. REFUNDS & EXCHANGES

   a)Due to the tedious, handcrafted nature of our products, we are unable to provide refunds or exchanges for custom orders.   

   b)We will not offer refunds for missed pickups.

4. CANCELATIONS

   a) If you wish to cancel your order with us outright, we must receive notification of your intent to cancel your order in writing. Changes and cancellations for orders are accepted up to 30 days (one month) before the scheduled pickup/ delivery date. We are unable to make changes to orders after that time frame. No refunds will be provided for any payments made on the order no matter the amount - if canceled at least 30 days in advance - we will be happy to transfer 50% of the payment made on that order to another order (under the same name) within 3 months from that date. We will provide no other refunds regardless of the circumstances. You will be required to pay the full amount if the order is canceled with less notice.

   b) The retainer payment, (deposit, to secure your cake order on our calendar) is non-refundable and non-transferable to other names. If we receive an order cancellation request less than 30 days prior to your event date, the balance payment is still due and is non-refundable and non-transferable to other names or different dates.

   c) Cake tasting payments are non-refundable and non-transferable if the appointment is canceled less than 48 hours prior to the scheduled time of pickup (in the case of a "to go" Cake Sample Box) or less than 72 hours prior to the scheduled consultation time (in the case of an in-person tasting with the chef). We require payment in full of your tasting fee in advance to confirm the appointment.

 

5. PICKUPS & DELIVERIES

   a) Once you or a designated party has picked up an order and signed for it, it is considered "accepted" – we will ask to make sure that everything is correct such as the design, flavor, message on the cake, etc. Refunds requested due to decorating style, writing, color shade, or general design will not be honored after signing for your cake. In some instances, you may bring the cake back in for design adjustments, but this is an additional charge if the cake has been signed for.

   b) All products are the customer's responsibility once they leave our shop. We cannot be held accountable for any damage that may occur to the cake during transport, set-up, or at any time thereafter. Upon pick-up, you will receive instructions on how to carry, transport, and store your cake. Please remember that cakes are very fragile, and damages such as cracks, smudges, or melted frosting can occur if not handled properly. Refunds will only be issued in accordance with the refund policies outlined in these terms and conditions.

   c) Our cake deliveries are scheduled on a first-come, first-served basis with a charge determined by distances. If your event is taking place during peak season (May through September) and your cake is otherwise eligible for delivery, this is not a guarantee that we will have the capacity to deliver your cake. In these instances, your cake may need to be picked up from the bakery instead. We will discuss the options with you based on our availability.

 

6. FRESH FLOWERS

If you wish to have fresh flowers arranged on your cake, it is your responsibility to supply the flowers. In choosing to have fresh flowers arranged on your cake, you acknowledge that fresh flowers are not food products, and may be toxic or contain pesticide/herbicide residues, dirt, insects, and/or other contaminants. All responsibility for the freshness, color, overall condition, and cleanliness of the flowers rests with you (and/or your event florist). If the fresh flowers for your cake have not been set aside on or near the cake table (for ease of locating them upon our arrival at your venue), then we reserve the right to set up your cake without fresh flowers. The nature of our cake delivery schedule typically prevents us from staying behind at your venue to wait for the flowers/florist to arrive.

 

7. POST-SETUP PRECAUTIONS

Once the cake assembly/setup is complete at your event venue, Soolicious Cake is not responsible for any damage to the cake other than damage that occurs as a result of improper construction/production. If your venue is outdoors, it is your responsibility to take the necessary precautions (shading, level ground, insect netting, wind protection, temperature control, etc.) to ensure that the cake remains intact beyond the initial setup.

 

8. GUARANTEE/ DISCLAIMER

   a) We do all that we can to make sure that your order is decorated to the specification on your written order form. Upon pick-up of your cake, adjustments can be made for an additional charge if it was not stated on your original order. If for some reason something is not decorated correctly as stated on your order, we will make necessary changes right away at no additional charge. 

   b) Every order is hand-made. Decorative finishes are done by hand and are subject to the artistic interpretation of our expert cake decorators. You may provide us with a photograph for inspiration and duplication; however, we make no claims for exact duplication of the work done by other cake decorators.
